Fifth suspect charged in Taylor case

MIAMI (Ticker) -- A fifth suspect has been charged in the
shooting death of former Washington Redskins safety Sean Taylor,
the Miami Herald reported Thursday.

The Herald reported that Timothy Brown, 16, was arrested
Thursday and charged with first-degree murder under a sealed
warrant.

On Tuesday, Miami-Dade prosecutors announced that they will not
seek the death penalty against suspects Eric Rivera, 18, Venjah
Hunte, 20, Charlie Wardlow, 18, and Jason Mitchell, 20. The
four men still face life in prison if convicted.

Hunte's attorney, Michael Hornung, told the Fort Myers
News-Press that the death penalty would have applied only if the
prosecutors could have shown the alleged crime was
premeditated.

In Rivera's case, the state likely would have been unable to
seek the death penalty anyway because Rivera, the alleged
shooter, was a minor - 17 years old - at the time of the crime.

On November 26, Miami-Dade police said the five suspects drove
to Taylor's house. When they arrived, they broke into his house
intending to burglarize it.

However, they found the 24-year-old Taylor, who was recovering
from a sprained right knee, at home with his wife and child.
The Pro Bowl safety was shot in the groin and died of blood loss
the next day.

A trial date of August 25 has been set for the four defendants.

Brown is Wardlow's cousin, and police believe he accompanied the
others to Taylor's home. He is jailed in Lee County and
awaiting transport to Miami-Dade County.
